It’s critical that the General Assembly adopt smart policies to attract future data center investments. KYFREE is concerned the “one size fits all” approach in HB 593 & SB 197 will short circuit this historic economic development opportunity.

The tech companies building the facilities should pay their fair share for their energy needs and ratepayers deserve protections. More important, Frankfort should “do no harm” in the final days of the ’26 session and avoid passing legislation that drives these opportunities to our surrounding states.

The legislators engaged in these discussions want what’s best for our state. It would be better to continue the conversations during the interim session than pass a bill that puts us at a competitive disadvantage for these transformational investments.
